A federal judge has thrown out the criminal charges against former FBI director James Comey and New York Attorney General Letitia James, citing the improper appointment of the prosecutor who pursued the cases at the behest of President Donald Trump. The judge’s rulings represent a significant rejection of the Trump administration’s attempts to target political opponents and underscore the rushed appointment of a prosecutor aligned with the president.

The judge’s actions disqualify Lindsey Halligan, another Trump administration prosecutor, due to the questionable circumstances of her appointment. This decision aligns with previous rulings against the administration involving U.S. attorneys in California, Nevada, and New Jersey. Despite the dismissals, the cases could potentially proceed under different officials.

In response to the dismissal, both Comey and James sought to have the cases permanently dismissed, but the judge opted to dismiss them without prejudice. The Justice Department’s next steps regarding the revived prosecutions remain uncertain.

James faced charges in a mortgage fraud investigation, while Comey was indicted shortly before a statute of limitations deadline for allegedly making false statements to Congress and obstructing a congressional proceeding. Comey expressed his views on the ruling through a social media video, emphasizing the need to prevent the misuse of the Department of Justice for political purposes.

The legal challenges to Halligan’s appointment were part of a broader effort by Comey and James to contest the indictments, citing vindictiveness and irregularities in the grand jury process. The White House indicated that the case is not closed, with plans for an immediate appeal by Attorney General Pam Bondi.

Comey, a vocal critic of Trump, was fired by the president in 2017 amid tensions over the Russia investigation. James, who secured a significant judgment against Trump, continues to face his scrutiny. Despite setbacks, Trump’s pursuit of adversaries through legal means is likely to persist beyond these dismissals.
